An order from an Alaska judge gives the US government the right to issue further penalties against two subsidiaries of American Seafoods Group (ASG) and others for their ongoing use of a 100-foot piece of railway in Canada to meet a Jones Act exemption.
Starting July 8, the day after the order issued by judge Sharon Gleason, the US department of Customs and Border Protection (CBP) is no longer prohibited from issuing fresh penalties against ASG's Kloosterboer International Forwarding (KIF) and Alaska Reefer Management (ARM) or anyone working with them using the Bayside Canadian Railway (BCR).
Gleason's order also clarifies the US government is, however, still "precluded" from enforcing the notices of penalty for use of the route prior to the initiation of the litigation [...]
